Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and Summit Veil LLC ("Summit Veil," "we," "us," or "our") and govern your use of the mobile application Serin: Privacy Radar and any related services (collectively, the "App"). Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not download or use the App.

2. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you may use the App only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.

3. Description of Service

Serin is a privacy-awareness tool that helps users identify nearby electronic devices using Bluetooth Low Energy (BLE) scanning, local network (WiFi) discovery, and infrared (IR) camera analysis.

Serin is an awareness tool, not a tool for confrontation, investigation, or emergency response. It is not a substitute for a professional Technical Surveillance Counter-Measures ("TSCM") sweep, law-enforcement assistance, or licensed security services. Do not rely on Serin in any situation where your safety may be at risk. If you believe you are the target of unlawful surveillance, stalking, or domestic abuse, contact local law enforcement or a qualified professional.

4. Detection Limitations & Safety Disclaimer

You acknowledge and understand that:

• Serin cannot guarantee detection of all surveillance devices. Detection depends on device type, configuration, distance, environmental conditions, and hardware capabilities of your iPhone.
• Smart glasses and similar wearables may only be detectable when first powered on or entering pairing mode. Once paired with a host device, many such products reduce their wireless signature and may no longer be continuously detectable. This is a hardware-level limitation of Bluetooth privacy.
• WiFi-based detection requires the target device to be on the same local network and advertising discoverable services.
• Infrared detection requires darkened conditions and an active IR-emitting target.
• False positives and false negatives may occur. A clear scan does not guarantee that an environment is free of surveillance devices.
• Detection results should be treated as one input among many, not as a definitive determination of risk.
• You should never use detection results as a basis for confronting, accusing, harassing, or harming another person.

5. Acceptable Use

You agree to use the App only for lawful, personal-privacy-awareness purposes and in compliance with all applicable laws. You agree not to:

• Use the App to harass, stalk, threaten, intimidate, or surveil any person.
• Use detection results as a basis for confrontation, vigilantism, or aggressive behavior.
• Use the App in violation of any local, state, national, or international law.
• Reverse-engineer, decompile, disassemble, or attempt to derive source code from the App, except to the extent expressly permitted by applicable law.
• Interfere with, probe, or disrupt the App, the Serin API, or any related infrastructure.
• Submit false, misleading, or spam device reports through community-submission features.
• Use the App to develop a competing product, or to scrape or mirror our detection database.

6. License Grant

Subject to your compliance with these Terms, Summit Veil grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial privacy awareness. All rights not expressly granted are reserved by Summit Veil.

7. In-App Purchases (Serin Pro)

Serin offers a one-time, non-consumable in-app purchase ("Serin Pro") that unlocks additional features. All purchases are processed by Apple through the App Store and are subject to Apple's Media Services Terms.

• Serin Pro is a one-time purchase. There are no subscriptions or recurring charges.
• Refund requests must be directed to Apple. Summit Veil does not have access to your payment information and cannot issue refunds directly.
• The specific features included in Serin Pro may evolve over time. We will not remove materially valuable features without offering equivalent replacements.

8. Community Features & User Submissions

The App includes community features such as device submissions and detection feedback. By using these features, you grant Summit Veil a non-exclusive, worldwide, royalty-free, transferable, sublicensable, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, and create derivative works of submitted data solely for the purposes of operating, securing, and improving the App and the detection database.

You represent and warrant that you have the right to submit any data you contribute and that your contributions do not infringe the rights of any third party or violate any law. We may remove or refuse to publish any contribution at our discretion.

9. Intellectual Property

The App and all of its content — including code, design, graphics, the Serin name and logo, detection algorithms, the device-signature database, and documentation — are owned by Summit Veil or its licensors and are protected by copyright, trademark, and other intellectual-property laws. Except for the limited license granted in Section 6, these Terms do not transfer any intellectual-property rights to you.

10. Apple-Specific Terms

You acknowledge that these Terms are concluded between you and Summit Veil only, and not with Apple Inc. or its subsidiaries ("Apple"). Apple is not responsible for the App or its content.

• Scope of license. The license granted to you in Section 6 is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms.
• Maintenance and support. Summit Veil is solely responsible for providing any maintenance and support services for the App. Apple has no obligation to furnish any maintenance or support.
• Warranty. Summit Veil is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
• Product claims. Summit Veil, not Apple, is responsible for addressing claims relating to the App, including (i) product-liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar legislation.
• Intellectual-property claims. In the event of any third-party claim that the App infringes that party's intellectual-property rights, Summit Veil, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUMMIT VEIL AND ITS LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

• the App will detect all surveillance devices in your environment;
• detection results will be accurate, complete, or error-free;
• the App will be uninterrupted, secure, or free of bugs; or
• the device-detection database will contain signatures for every surveillance device.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SUMMIT VEIL, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF OR IN CONNECTION WITH:

• your use of, or inability to use, the App;
• any failure or alleged failure of the App to detect a surveillance device or other security threat;
• any action you take, or fail to take, based on detection results, including any confrontation or physical altercation;
• any unauthorized access to or alteration of your data; or
• the conduct or content of any third party.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US (THROUGH APPLE) FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) FIFTY U.S. DOLLARS (US$50.00).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Summit Veil, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your use or misuse of the App, (b) your violation of these Terms, (c) your violation of any law or the rights of any third party, or (d) your contributions to the community features.

14. Termination

We may suspend or terminate your access to the community features (submissions, feedback) and the Serin API at any time if we believe you have violated these Terms or engaged in abusive behavior. The locally installed App will continue to function for on-device features unless you uninstall it or Apple removes it. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination — including Sections 8 (license to submissions), 9, 11, 12, 13, 15, 16, and 17 — will survive.

15. Governing Law & Venue

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. The state and federal courts located in Wyoming will have exclusive jurisdiction over any dispute arising under these Terms, and you consent to personal jurisdiction in those courts.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the App or by updating the "Effective date" above. Continued use of the App after the effective date of the revised Terms constitutes your acceptance of them. If you do not agree to the revised Terms, you must stop using the App.

17. Miscellaneous

• Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Summit Veil regarding the App and supersede any prior agreements.
• Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
• No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
• Force majeure. We are not liable for any delay or failure to perform resulting from causes outside our reasonable control.
• Headings. Section headings are for convenience only and do not affect interpretation.
